Everyone who uses Fox Care
Terms of Service
The agreement between you and Fox Care for using the platform.
Version 1.0 · Effective 13 October 2026 · Fox Care Pty Ltd
The short version
- Fox Care engages nurses and care workers and supplies them to care providers for shifts.
- Workers are casual employees of Fox Care, not of the provider they work for.
- Prices are shown before a shift is posted or accepted, and are fixed from that moment.
- Accounts are checked by hand before use, and must be kept accurate and current.
- Governed by the laws of New South Wales.
A summary to help you find your way. The full terms below are what apply.
1. Who we are
Fox Care Find & Match (“the platform”) is operated by Fox Care Pty Ltd, ABN 34 683 751 742 (“Fox Care”, “we”, “us”). These terms are an agreement between you and Fox Care.
By creating an account, signing in, or using the platform you agree to these terms. If you are agreeing on behalf of an organisation, you confirm that you are authorised to bind it, and “you” includes that organisation.
2. The other documents that apply
These terms sit alongside the following, which form part of your agreement with us:
- Privacy Policy and Cookie Policy — everyone
- Care Worker Agreement — nurses and care workers
- Care Provider Agreement — organisations that post shifts
- Cancellation Policy, Code of Conduct, Work Health and Safety Policy and Complaints and Feedback Policy — everyone
If a specific agreement conflicts with these general terms, the specific agreement applies.
3. What Fox Care does
Fox Care engages qualified nurses and care workers and supplies them to healthcare providers for shifts the providers post on the platform. We verify each worker's credentials before approving them, set the rates paid to workers and charged to providers, record timesheets, invoice providers and pay workers.
Workers who take shifts through Fox Care are engaged by Fox Care as casual employees, on the terms in the Care Worker Agreement. They are not employees of the provider they work for on a shift.
4. Your account
- You must be at least 18 years old. Workers must be legally entitled to work in Australia.
- Everything you give us must be true and kept up to date — including qualifications, registrations, checks, visa status, bank and contact details.
- You sign in with a one-time code sent to your email or mobile, or with a linked Google account. Keep access to them secure. You are responsible for what is done through your account, and must tell us straight away if you think someone else has access.
- One account per person. Do not share your account or let anyone work under your name.
5. Verification and approval
New accounts are reviewed by hand before they can be used. We may ask for proof of identity, professional registration (for example with AHPRA), police and worker screening checks, immunisation records, visa evidence and an ABN.
Approval means a worker met our checks on the day they were made. It is not a guarantee that a worker suits a particular setting, and it does not replace a provider's own obligations to induct and supervise.
If a required document expires or is withdrawn, the account stops being matched to new shifts until a current one is provided.
6. Shifts
A shift is booked the moment a worker accepts it. Shifts go to whoever accepts first; being shown or offered a shift does not reserve it. A provider may advertise a shift to every matching worker or offer it to named workers.
Once booked, both sides are committed. Changes and cancellations are governed by the Cancellation Policy.
7. Rates, pay and invoices
Rates are set by Fox Care and shown before a shift is posted or accepted. The price of a shift is fixed when it is posted, so a later change to rates does not alter work already agreed. The amount a worker is paid and the amount a provider is charged are different figures; the difference is Fox Care's fee.
Pay and charges are calculated from approved timesheet hours, using the rules that applied when the shift was posted. Providers are invoiced weekly in arrears and workers are paid on Fox Care's weekly pay run. Details are in the Care Worker Agreement and the Care Provider Agreement.
8. Acceptable use
You must not:
- give false information, or misrepresent your qualifications, identity or hours worked;
- use the platform to arrange work privately so as to avoid Fox Care (see the provider and worker agreements);
- harass, threaten or discriminate against anyone;
- try to access information or accounts that are not yours, interfere with the platform, or copy it or its data by automated means;
- use the platform for anything unlawful.
9. The platform
We work to keep the platform available and accurate, but it is provided as it is and may occasionally be unavailable for maintenance or for reasons outside our control. We may change, add or remove features. The platform, its design and content belong to Fox Care; you may use it only for its intended purpose.
10. Liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, or any entitlement a worker has under the Fair Work Act 2009 or an award, that cannot lawfully be excluded.
Subject to that, and to the extent permitted by law: Fox Care is not liable for any indirect or consequential loss; and our total liability to a provider arising out of the use of the platform is limited to the fees Fox Care received from that provider in the 12 months before the claim arose.
11. Suspension and closure
We may suspend or close an account for a breach of these terms or the Code of Conduct, an expired or withdrawn credential, unpaid invoices, or conduct that puts anyone at risk. Where it is safe and reasonable, we will tell you why and give you a chance to respond.
You can close your account at any time by contacting us. Shifts already booked, amounts owing, and records we are required by law to keep survive closure.
12. Changes to these documents
We may update these terms and the other documents. We will tell you about material changes before they take effect. Each document shows its version and the date it took effect. If you keep using the platform after a change takes effect, the new version applies.
13. Governing law
These terms are governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales.
